These Terms and Conditions govern access to and use of the eDesign.com.pa website and describe the general framework under which eDesign provides its digital consulting services. By browsing this site or contacting us through it, you accept what is set out here.

Who we are

eDesign is a digital strategy consultancy operating in Panama City, Republic of Panama, specialized in web presence audit and security, management of innovation projects with artificial intelligence, and data-driven digital marketing strategy.

Acceptance of these terms

Use of this site implies full acceptance of these Terms and Conditions. If you do not agree with any of them, we ask that you refrain from using the site or from sending us information through the channels published here.

These terms apply to the use of the website. The specific conditions of each contracted service are established in the proposal or contract signed with each client, a document that prevails over what is described here in the event of any discrepancy.

Nature of the site content

The information published on eDesign.com.pa is informational and commercial in nature. The description of services, methodologies and cases does not constitute a binding offer or a commitment to specific results.

The diagnostic panel shown on the home page is a visual demonstration. It does not analyze the domain the visitor types, it does not send that information to any server, and it does not generate any report. The real security diagnosis is performed by a consultant on the client’s authorized infrastructure, by prior arrangement.

Engaging our services

Every eDesign service is formalized through a written proposal defining scope, deliverables, timelines, commercial conditions and validity. No work begins without the client’s express acceptance of that proposal.

• The contracted scope is the one stated in writing. Any task outside that scope is quoted separately.
• Quotes are valid for the period stated in the document itself.
• Estimated timelines depend on the client providing access, information and approvals in a timely manner.

Scope of the security services

This point deserves clarity, because it is the core of what we do.

eDesign’s audit, remediation and prevention services are provided by applying recognized industry best practices and professional tools. However, no security measure can guarantee absolute invulnerability. The threat environment changes continuously, and there are attack vectors beyond the control of any provider.

Accordingly:

• An audit reflects the state of the evaluated infrastructure on the date it is performed.
• eDesign does not guarantee that a system will remain free of future incidents, nor does it assume liability for attacks originating in components, platforms or credentials outside its management.
• The client retains responsibility for safeguarding its credentials, managing its personnel’s access, and the decisions it makes regarding the recommendations delivered.
• Audit work is performed only on infrastructure owned by the client, or over which the client can evidence express authorization.

User obligations

• Provide truthful and up-to-date information when contacting us or engaging our services.
• Not use this site for unlawful or fraudulent purposes, or in any way that may impair its operation.
• Not attempt to access restricted areas, systems or data associated with the site without authorization.
• Hold legitimate authorization over any domain, system or infrastructure for which you request our services.

Intellectual property

The eDesign brand, its logo, its visual identity, and the texts, illustrations, code and other elements of this site are the property of eDesign or are used with due authorization. Their reproduction, distribution or modification without prior written consent is prohibited.

With respect to deliverables produced for clients, ownership and usage licenses are defined in the proposal or contract corresponding to each project.

Trademarks, trade names and logos of clients or third parties appearing on this site belong to their respective owners and are shown for reference purposes only.

Third-party links and services

This site contains third-party links and components, including WhatsApp, social networks and Google services. eDesign does not control those platforms and is not responsible for their content, policies or availability. Your use of them is governed by each provider’s own terms.

Communications

eDesign’s primary contact channel is WhatsApp, complemented by email. By writing to us through either of these means, you accept that we will use those same channels to reply to you and follow up on your inquiry.

WhatsApp is a service operated by a third party. For sensitive information requiring a more controlled channel, we will arrange an alternative means with you.

Limitation of liability

eDesign shall not be liable for indirect damages, loss of profits or loss of data arising from the use of this site or the information published on it. Liability for contracted services is governed by the terms of the corresponding proposal or contract.

The site is provided "as is". We strive to keep the information current and accurate, but we do not guarantee the complete absence of errors or omissions.

Site availability

We work to keep the site continuously available, but interruptions may occur due to maintenance, updates or causes beyond our control. We reserve the right to temporarily suspend access when necessary.

Amendments

eDesign may update these Terms and Conditions at any time. The version in force will always be the one published on this page, with its last-updated date visible in the header.

Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Panama. Any dispute arising from their interpretation or application shall be submitted to the competent courts of the Republic of Panama, unless otherwise agreed in the services contract.
