Privacy Policy

At eDesign we spend every day protecting our clients’ information. It would be inconsistent not to be just as careful with yours. This policy explains, without unnecessary jargon, what data we collect, what we use it for, and what control you have over it.

Language of this document: this is an English translation provided for convenience. The Spanish version, published at eDesign.com.pa/privacidad.html, is the binding version in the event of any discrepancy of interpretation.

Legal framework

This policy is governed by Law 81 of 26 March 2019 on the Protection of Personal Data of the Republic of Panama and its regulations in force. The competent authority on this matter is the National Authority for Transparency and Access to Information (ANTAI).

What data we collect

Data you give us

This site has no data-capture forms. The personal data we process is only what you choose to send us when you write to us on WhatsApp or by email, and it usually includes:

  • First and last name.
  • Phone or WhatsApp number.
  • Email address.
  • The name of your company, professional practice or domain.
  • The description of the problem or project you bring to us.

Technical browsing data

If you allow analytics or marketing cookies, we collect technical data such as approximate IP address, browser and device type, pages visited, time spent and traffic source. Without that authorization, this data is not collected.

About the visual diagnostic on the home page: the field where you can type a domain is a demonstration. It analyzes nothing, it does not send what you type to any server, and it does not store it in any database.

What we use your data for

  • To answer your inquiry and follow up on it.
  • To prepare the proposals, quotes and diagnostics you request.
  • To provide and manage the contracted services.
  • To comply with legal, accounting and tax obligations.
  • To measure the performance of the site and of our campaigns, where you have authorized it.

We do not sell, rent or transfer your personal data to third parties for commercial purposes.

Legal basis for processing

We process your data on the basis of your prior, informed and unambiguous consent, given when you voluntarily contact us or when you accept the cookie categories in the site notice. We also process data where it is necessary to perform a services contract or to comply with a legal obligation.

You may withdraw your consent at any time, without affecting the lawfulness of processing carried out beforehand.

Cookies and similar technologies

When you enter the site we show you a notice with three categories. No measurement or advertising tag loads before you decide.

  • Necessary. They make the site work and remember your decision about these preferences. Always on.
  • Analytics. Google Analytics. They tell us which sections get visited and where visitors come from, so we can improve the site. They are activated only with your authorization.
  • Marketing. Google Ads and remarketing. They let us measure and adjust our campaigns. They are activated only with your authorization.

We apply Google’s consent model (Consent Mode), which keeps advertising and analytics storage denied by default until your express authorization is received.

You can change your decision at any time from the Cookie preferences link in the site footer, or by deleting cookies from your browser settings. Your choice is kept for twelve months.

Who we share information with

We share data only with the providers that allow us to operate, and only to the extent necessary:

  • Google (Analytics and Ads), if you authorized those categories.
  • Hosting and business email providers that host our infrastructure.
  • WhatsApp, as a communication channel operated by a third party.
  • Competent authorities, where there is a legal requirement.

Some of these providers process information on servers located outside Panama. By using our digital channels, you acknowledge that an international transfer of data may take place to jurisdictions with recognized protection standards.

How long we keep your data

  • Inquiries that do not lead to an engagement: up to twenty-four months from the last contact.
  • Active client data: for as long as the commercial relationship lasts.
  • Documentation subject to a legal retention obligation: for the period required by Panamanian law.
  • Cookie preferences: twelve months.

Once those periods have elapsed, the data is deleted or anonymized.

Your rights

Law 81 of 2019 grants you the following rights over your personal data:

  • Access: to know what data of yours we process.
  • Rectification: to correct inaccurate or incomplete data.
  • Erasure: to request deletion when the data is no longer necessary.
  • Objection: to object to a specific processing activity on legitimate grounds.
  • Portability: to receive your data in a commonly used format.

To exercise them, write to [email protected] stating your name, the right you wish to exercise and a means of contact. We will respond within the periods established by law. If you believe your request was not handled properly, you may turn to ANTAI.

Information security

We apply technical and organizational measures to protect your data: encryption in transit via SSL certificate, access control, backups and periodic review of our own infrastructure, with the same standard we apply when auditing our clients’.

That said, and in the interest of transparency: no system is invulnerable in absolute terms. In the event of an incident affecting your personal data, we will act in accordance with the law and notify you promptly.

Minors

Our services are aimed at companies, professionals and adults. We do not knowingly collect data from minors. If we detect that we have received information from a minor without their legal guardian’s authorization, we will proceed to delete it.

Changes to this policy

We may update this policy when our services or the applicable regulations change. The version in force will always be the one published on this page, with its last-updated date visible in the header.
